2. Description of the Service
WA-Assistant is a Software-as-a-Service (SaaS) application that delivers artificial intelligence (AI) powered reply recommendations for WhatsApp chats. The Service interfaces with your connected WhatsApp account to process incoming messages and suggest context-aware responses to improve business productivity and response latency.
We reserve the right to modify, restrict, update, or discontinue any feature, daily limit, or portion of the Service at our sole discretion at any time.
3. Account Registration & WhatsApp Integration
To utilize the Service, you must create a user account. You agree to provide accurate information and are fully responsible for safeguarding your login credentials.
WhatsApp Account Linking
The Service requires linking your active WhatsApp account via a secure bridge connection. You represent and warrant that you own or have full legal authority to connect the WhatsApp account. You agree to use the Service in complete compliance with WhatsApp's/Meta's official Terms of Service and Commerce Policies.
4. Subscriptions, Payments & Billing
All payment processing, billing records, and card transactions are handled securely by our third-party billing provider, Stripe. No payment card details are stored or accessed by the Service.
Pricing & Tiers
- Free Trial: Subject to a daily limit of 20 AI suggestions. No credit card required.
- Weekly Pass: A one-off payment granting access to 1,000 suggestions valid for 7 days. This is a non-recurring purchase and does not auto-renew.
- Monthly Plan: An auto-renewing subscription that bills monthly. By subscribing, you authorize us to charge your Stripe payment method on a recurring basis.
Taxes
Prices displayed on the website are inclusive of European VAT at the statutory rate applicable to your country of residence.
5. Cancellation & Refund Policy
You may cancel your monthly subscription at any time. Cancellation can be executed directly in one click through the billing dashboard in your account settings.
Cancellation Terms
Upon cancellation of a monthly plan, your active subscription will remain operational until the end of your current paid billing cycle, after which it will downgrade to the free tier. One-off Weekly Passes cannot be cancelled.
Refunds Policy
Due to the digital nature of the Service and the immediate allocation of server-side AI processing power and APIs upon purchase, all payments are non-refundable. Exception is granted only to EU residents exercising their statutory right of withdrawal within 14 days, provided they have not connected a WhatsApp account or generated any AI suggestions during that period.
6. Security, Encryption & Privacy
We enforce strict system security measures. All WhatsApp message logs, contact records, and AI-generated suggestions are encrypted at rest using industry-standard symmetric AES-256-GCM encryption.
The decryption keys are isolated and only active in temporary server memory during an authorized user session. Personal data collection and cookies are governed by our Privacy Policy.
7. Disclaimer of Warranties & Limitation of Liability
The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
WhatsApp Account Block Disclaimer
WhatsApp/Meta enforces strict spam and automated behavior detection algorithms. You acknowledge that you use the Service entirely at your own risk. The Service Provider shall not be held liable or responsible for any restrictions, temporary suspensions, or permanent blocks imposed by WhatsApp/Meta on your phone numbers or accounts.
General Limitation of Liability
To the maximum extent permitted by law, the Service Provider shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from: (i) the use or inability to use the Service; (ii) any connection downtime, latency, or API failure on the part of WhatsApp or Google Gemini; or (iii) unauthorized access to or alteration of your communications.
8. Governing Law & Jurisdiction
These Terms of Service, their interpretation, and any disputes arising in connection with the Service shall be governed exclusively by the laws of Portugal.
Any legal action or proceeding arising out of or related to these Terms shall be brought exclusively in the competent courts of Portugal.
